Otter Tail County Recorder

The Otter Tail County Recorder maintains all legal real estate records for the county. The office records deeds, mortgages, satisfactions, liens, easements, plats, federal and state tax liens, and any other documents affecting land ownership. Documents must meet state requirements before staff will accept them. That means original signatures, proper notary acknowledgment, a full legal description of the property, and the preparer's name on the first page.

E-recording is available in Otter Tail County, so you can submit documents electronically if you work with an e-recording provider. Paper submissions are also accepted in person or by mail. Documents must arrive by 4:15 PM to be recorded that day. The office stays open until 4:30 PM, but the recording cutoff is 15 minutes earlier. If you mail documents, confirm the fee in advance and include a self-addressed return envelope.

The Recorder also maintains Torrens title records under Minnesota Statutes Chapter 508. Torrens properties have a Certificate of Title rather than an abstract chain. Both abstract and Torrens records are kept at the county level.

Otter Tail County Property and Tax Services

The Property and Tax Services office handles assessments and tax collections for all parcels in Otter Tail County. The office sets estimated market values as of January 2 each year, using recent sales data and regular property inspections. Valuation notices go out in March. If you believe your value is too high, you can appeal before the Board of Appeal and Equalization meets in April. No fee is required to appear before the local board.

Otter Tail County covers a large area with a wide mix of property types. Residential homes, agricultural land, commercial lots, and lake shore properties all follow different assessment rules. The assessor classifies each parcel based on its current use. With more than 1,000 lakes in the county, many parcels are seasonal cabins and lake homes. If your appeal is not resolved at the local board level, you can take it to the County Board of Equalization and then to the Minnesota Tax Court. The deadline to file with the Tax Court is generally 30 days after the local board issues its decision.

Property Records in Otter Tail County

The Recorder's office holds all documents that affect real property in Otter Tail County. Deeds are the most frequently recorded type. Under Minnesota Statutes Chapter 507, a deed must be recorded to give public notice of an ownership transfer. Without recording, the new owner is not protected against later claims by other buyers or creditors who did not know about the sale.

Mortgages are recorded when a lender takes a security interest in the property. Satisfactions are recorded when the loan is paid off. Other documents include easements, declarations of restrictions and covenants, federal and state tax liens, mechanics liens, certificates of survey, and plats. Well disclosure certificates are required on nearly all residential transfers. The certificate is either attached to the deed or filed separately for $50. UCC filings are also accepted at this office.

The Minnesota Department of Revenue maintains a statewide system called PRISM that pulls property and assessment data from all counties, including Otter Tail. This is useful for comparing property data across county lines.

Recording Fees and Transfer Taxes

Otter Tail County recording fees match the state standard. The base fee is $46 for the first page of any document, plus $4 for each additional page. Plats cost $56 to record. Well disclosure certificates filed separately are $50, but no extra fee applies if the certificate is attached to the deed when it is recorded.

Two state taxes apply when real estate changes hands. The State Deed Tax under Minnesota Statutes Chapter 287 is 0.33% of the net sale price, with a minimum of $1.65. On a $250,000 sale, the deed tax is $825. The Mortgage Registry Tax is 0.23% of the loan amount. On a $200,000 mortgage, that comes to $460. Both taxes are due at the time of recording.

Certified copies of recorded documents cost $10 as a base fee plus per-page charges. Non-certified copies are less. Requests can be made in person or by mail. Include a check and a self-addressed stamped envelope when mailing.

Property Tax in Otter Tail County

Property taxes in Otter Tail County follow the payment schedule set under Minnesota Statutes Chapter 279. The first half of the annual bill is due May 15. The second half is due October 15. Missing the May 15 deadline causes the unpaid balance to become delinquent on January 1 of the next year, at which point interest and penalties begin to add up.

Values are set as of January 2 each year under the framework in Chapter 272 and the assessment rules in Chapter 273. Tax statements and valuation notices go out in March. That gives you time to check your value and appeal if needed. The Board of Appeal and Equalization meets in April to hear local challenges.

If taxes remain unpaid for three years, the county can take title through the forfeiture process. Forfeited properties may eventually be sold at public auction.
