Grant County Recorder

The Grant County Recorder is at 10 2nd Street NE, Room 249, in Elbow Lake. The mailing address is PO Box 1016, Elbow Lake, MN 56531. This office maintains all official real estate records for the county. Deeds, mortgages, plats, contracts for deed, easements, and liens are all filed and indexed here. Under Minnesota Statutes Chapter 507, recording gives legal notice to the public of any ownership transfer or lien. That notice is what protects buyers and lenders from prior unrecorded claims. Every document gets a date and time stamp along with a document number when it is accepted for recording.

E-recording is available for attorneys and title companies. Walk-in submissions are accepted until 4:15 PM on business days. Documents received after that cut-off time are processed the following morning. The Recorder's office can search the index by party name, document number, or legal description. Certified copies of recorded documents cost $10 plus per-page fees. The office handles a smaller volume than metro counties, which makes it easier to reach staff directly by phone for help finding a specific record.

Grant County is a smaller county with about 7,000 parcels. That smaller size means staff tend to be familiar with local properties and can often help researchers find what they need quickly. The Recorder does not give legal advice but can direct you to the right records.

Grant County Assessor

The Grant County Assessor's office is at the same courthouse address as the Recorder in Elbow Lake. The phone number for the Assessor is (218) 685-4726. With about 7,000 parcels in the county, the Assessor values and classifies all real property as of January 2 each year under Minnesota Statutes Chapter 273. Grant County has a mix of agricultural land, lake shore properties, and small residential communities. The valuation process for each type follows different rules under state law, with farmland values tied to productive capacity and lake properties valued based on market activity.

Valuation notices go out in March. If you disagree with your assessed value, you can appear before the local Board of Equalization in the spring. Bring evidence to support your position. A recent appraisal, comparable sales in the area, or documentation of property defects all help your case. After the local board, the County Board of Appeal and Equalization is the next level of review if you are not satisfied with the outcome.

Physical inspections are done on a five-year cycle. The Assessor visits each property to record its condition and note any changes. Between inspection years, market data and sales analysis drive the annual value updates. Homestead applications for owner-occupied primary residences are accepted year-round and can lower the tax classification rate for qualifying owners.

Property Documents in Grant County

The Grant County Recorder holds all types of real estate instruments. Warranty deeds convey ownership with a full guarantee of title from the grantor. Quit claim deeds transfer whatever interest the grantor holds, with no warranty, and are common in family transactions and estate matters. Contracts for deed let sellers finance purchases directly while retaining legal title until the buyer pays in full. Recording these documents in Grant County is required to protect each party's interest against later claims. The requirement comes from Minnesota Statutes Chapter 507, which applies across the state.

Mortgages are recorded here when lenders take a security interest in real property. Satisfaction of mortgage releases the lien when the loan is paid. In cases of foreclosure, the sheriff's certificate and eventual sheriff's deed are also part of the county's permanent records. These documents create a chain of title that any buyer or lender can trace back through the county's index. Minnesota Statutes Chapter 272 covers the overall property tax and ownership framework that applies to all of these records in Grant County.

Easements for utilities, drainage, and access are also recorded and run with the land regardless of ownership changes. Plats for new subdivisions cost $56 to record and must go through county review first. Well disclosure certificates are filed with every deed and remain permanently attached to the property's record. Grant County, like all Minnesota counties, maintains these records going back to the county's original organization.

Recording Fees and Transfer Taxes

Grant County follows the state recording fee schedule. The first page of any document costs $46. Each additional page is $4 more. If one instrument covers multiple titles, each additional title adds $46. Plats are $56 to record. Certified copies of recorded instruments are $10 plus per-page copy fees. These amounts apply whether you submit in person or through e-recording.

State transfer taxes are collected at recording under Minnesota Statutes Chapter 287. The State Deed Tax is 0.33% of the net consideration, with a minimum of $1.65. On a $130,000 property sale, the deed tax is $429. The Mortgage Registry Tax is 0.23% of the principal amount of any new mortgage. A $100,000 mortgage carries a $230 Mortgage Registry Tax. Both taxes are due when the deed or mortgage is submitted for recording. The Recorder will not process taxable documents without payment of these amounts.

Note: Transfer tax calculations are based on the net consideration stated on the deed. Make sure the consideration is accurate before recording to avoid issues with the Recorder or future tax authorities.

Property Taxes in Grant County

Grant County property taxes are based on the assessed value set each January 2. Tax statements go out in March. Under Minnesota Statutes Chapter 279, the first half of the annual bill is due May 15 and the second half is due October 15. You can pay in person at the courthouse in Elbow Lake, by mail, or online through the county. Property owners with mortgages typically pay through an escrow account managed by their loan servicer.

Taxes that are not paid on time become delinquent January 1 of the next year. Interest at 9% to 10% per year is charged on the unpaid balance. If taxes remain unpaid for three years, Grant County can start the tax forfeiture process. Forfeiture results in the permanent loss of ownership. The county then takes title to the property and may offer it for sale. Property owners who are behind on taxes should contact the county office in Elbow Lake as soon as possible. Options may exist for payment arrangements depending on the situation.

State programs that may help Grant County property owners include the Homestead Market Value Credit, the Senior Citizen Property Tax Deferral, and the statewide Property Tax Refund program. These are administered by the Minnesota Department of Revenue at revenue.state.mn.us. Renters in Grant County may also qualify for a refund under the renter's credit program.
