Clay County Recorder

The Clay County Recorder records and maintains all real estate records for land in the county. The office accepts deeds, mortgages, satisfactions, federal and state tax liens, mechanic's liens, well disclosure certificates, Torrens documents, and UCC filings. All documents must meet Minnesota state standards including original signatures, notary acknowledgment, a clear legal description, and the document preparer's name on the first page.

Clay County accepts electronic recording through approved vendors, which speeds up the process for title companies and lenders. Paper documents are accepted Monday through Friday until 4:15 PM. The office stays open until 4:30 PM. If you are mailing a document, confirm the fee before sending. Certified and uncertified copies are available by request. Clay County Assessor and Treasurer

The Assessor/Treasurer Department administers property assessments and tax collections for all parcels in Clay County. The office sets estimated market values as of January 2 each year using sales data and physical inspections. Valuation notices go out in March. If you believe your value is wrong, you can appeal before the Board of Appeal and Equalization meets in April. There is no fee to file with the local board.

Types of Property Records in Clay County

The Clay County Recorder maintains a full range of legal documents affecting real property in the county. Deeds are the most common type. A deed transfers ownership and must be recorded to provide public notice under Minnesota Statutes Chapter 507. Without recording, the transfer is not protected against claims by other buyers or creditors who lacked notice of it.

Mortgages, mortgage satisfactions, and releases are also recorded here. When a lender has a security interest in a property, they record a mortgage. When the loan is paid off, the lender records a satisfaction. Other documents include easements, declarations of covenants, federal and state tax liens, mechanic's liens, plats, and certificates of survey. Well disclosure certificates are required on most property transfers and are either attached to the deed or filed separately.

Under Minnesota Statutes Chapter 508, some Clay County properties are registered under the Torrens system. Torrens titles use a court-issued Certificate of Title instead of a chain of recorded documents. Both abstract and Torrens records are maintained at the Recorder's office in Moorhead.

Clay County Recording Fees

Recording fees in Clay County follow the Minnesota state standard. The base fee is $46 for the first page of any document, plus $4 for each additional page. Plats cost $56. Well disclosure certificates cost $50 if filed separately, but the fee is included in the deed fee if the certificate is attached at the time of recording.

The State Deed Tax under Chapter 287 is 0.33% of the net consideration, with a minimum of $1.65. On a $200,000 sale, that is $660. The Mortgage Registry Tax is 0.23% of the principal debt. On a $160,000 loan, that is $368. Both taxes are paid at the time of recording. Certified copies cost $10 as a base fee plus per-page charges. UCC filings run from $15 to $50 depending on page count.

Clay County Property Tax

Property taxes in Clay County follow the schedule under Minnesota Statutes Chapter 279. The first half is due May 15. The second half is due October 15. Unpaid amounts become delinquent on January 1 of the next year and accrue interest at 9 to 10 percent annually. Tax statements are mailed in March.

Valuation and tax rules under Chapter 272 and Chapter 273 govern how Clay County sets values and calculates taxes each year. Values are set as of January 2. Properties with three consecutive years of unpaid taxes can enter forfeiture and may be sold at public auction. Online payment is available through the county.
