Mower County Recorder

The Mower County Recorder is the official keeper of all legal real estate records in the county. The office records deeds, mortgages, satisfactions, federal and state tax liens, easements, UCC filings, and other documents that affect ownership or use of real property. Documents must meet Minnesota state requirements before the office will accept them for recording. That includes a proper legal description, original notary acknowledgment, signatures, and the preparer's name on the first page.

Mower County accepts e-recording, allowing title companies and attorneys to submit documents electronically. For paper submissions, bring them to the office at 201 1st Street NE in Austin. Documents must arrive by 4:15 PM each weekday to be recorded that day. The office stays open until 4:30 PM, so arrive early if you need assistance from staff. Mower County Property and Tax Services

The Mower County Property and Tax Services office handles assessments, property classification, homestead applications, and tax collections for all parcels in the county. Mower County has approximately 22,000 parcels, a mix of agricultural land and urban properties centered around Austin. Values are set as of January 2 each year using recent sales data and field inspection results. Valuation notices and tax statements go out in March.

The Board of Appeal and Equalization meets in April to hear challenges from property owners who believe their assessed value is too high. Appeals at the local level are free. If you want to escalate, you can go to the County Board of Equalization and then to Minnesota Tax Court. All parcels receive a physical inspection at least once every five years. The assessor classifies each parcel based on its current use, which determines which tax rates and exemptions apply. Homestead applications are accepted year-round for owners who occupy the property as their primary residence.

Mower County Property Record Types

The Mower County Recorder maintains all documents that affect ownership or use of real property in the county. Deeds are the most common. Under Minnesota Statutes Chapter 507, recording a deed gives public notice of the transfer and protects the new owner against subsequent claims from other buyers or creditors. Without recording, ownership can be disputed.

Mortgages and mortgage satisfactions are also frequent filings. When a lender finances a property purchase, they record a mortgage to establish their security interest. When the loan is paid off, the lender records a satisfaction or release. Other documents include easements, declarations of covenants and restrictions, UCC filings, federal and state tax liens, mechanics liens, plats, and certificates of survey. Well disclosure certificates are required on most property transfers where a well exists and must be filed at or before recording the deed.

Some Mower County parcels are registered under the Torrens system under Minnesota Statutes Chapter 508. Torrens titles use a court-issued Certificate of Title rather than a chain of abstract documents. The Recorder can clarify which system applies to any parcel you are researching. The statewide PRISM system also aggregates property record data from Mower County and all other Minnesota counties.

Recording Fees and Transfer Taxes

Mower County follows the statewide recording fee schedule. The base fee is $46 for the first page of any document, plus $4 for each additional page. Plats cost $56 to record. A well disclosure certificate submitted separately costs $50. No extra fee applies when the certificate is attached to the deed at the time of recording.

State transfer taxes apply to most real estate transactions in Mower County. The State Deed Tax under Minnesota Statutes Chapter 287 is 0.33% of the net consideration, with a minimum of $1.65. On a $180,000 sale, that comes to $594. The Mortgage Registry Tax is 0.23% of the principal loan amount. On a $150,000 mortgage, the tax is $345. Both must be paid at the time of recording.

Certified copies of recorded documents cost $10 plus per-page charges. Plain copies are available for less. Submit copy requests in person at 201 1st Street NE in Austin or by mail. If mailing, include a check for the correct amount and a self-addressed return envelope.

Property Tax in Mower County

Property taxes in Mower County are due in two installments each year under Minnesota Statutes Chapter 279. The first half is due May 15. The second half is due October 15. If you miss the May 15 deadline, your taxes become delinquent on January 1 of the next year and interest starts accruing at 9 to 10 percent annually.

Values are set as of January 2 each year under the rules in Chapter 273. The general framework for levying and collecting taxes is governed by Chapter 272. Valuation notices and tax statements go out in March. If you disagree with your assessed value, bring the issue before the Board of Appeal and Equalization in April. After three years of unpaid taxes, the county can begin forfeiture proceedings, and the property may eventually be sold at public auction.
