Fillmore County Recorder

The Fillmore County Recorder's office is in Room 210 at 101 Fillmore Street in Preston, with a mailing address of PO Box 466, Preston, MN 55965. The office records and indexes all real estate documents for the county. When you record a deed, mortgage, or other instrument here, it becomes part of the public record and gives notice to anyone who later searches the index. That legal notice is what makes recording so important in any real estate transaction. Minnesota Statutes Chapter 507 requires recording to make a transfer effective against third parties.

E-recording is available for attorneys and title companies. Walk-in documents must arrive before 4:15 PM to be processed the same day. The office handles both abstract and Torrens property. Torrens property has a Certificate of Title under Chapter 508 that serves as the definitive ownership record. Fillmore County Assessor

The Assessor values and classifies all real property in the county as of January 2 each year. With about 11,000 parcels in the county, the Assessor handles a range of property types including farmland, single-family homes, rural acreage, and commercial properties. Values under Chapter 273 are based on market conditions and physical characteristics of the property.

Valuation notices go out each March. Homeowners who think their assessed value is wrong can appeal to the local Board of Equalization, which meets in the spring. Bring evidence that supports your claim. A recent independent appraisal carries the most weight, along with sales data from comparable properties in the area. The county Board of Appeal and Equalization is the next step if the local board does not resolve your concern.

Physical inspections are conducted on a five-year cycle. Assessors visit properties to record condition, square footage, and any improvements that may have changed the value. Between cycles, market data drives the annual adjustment to assessed values. Homestead applications, which can reduce the tax rate for owner-occupied properties, are accepted at any time during the year.

When a deed is recorded, the State Deed Tax must also be paid under Minnesota Statutes Chapter 287. The rate is 0.33% of the net purchase price, with a minimum of $1.65. A property that sells for $175,000 would carry a deed tax of $577.50. The Mortgage Registry Tax of 0.23% applies to any new mortgage. A $140,000 mortgage means a $322 tax. Both are due at the time of recording. The Recorder collects them along with the recording fee when the document is submitted.

Property Taxes in Fillmore County

Fillmore County property taxes are billed each March based on the assessed value from the prior January. Under Minnesota Statutes Chapter 279, the first half of the annual tax is due May 15 and the second half is due October 15. You can pay in person at the courthouse in Preston, by mail, or online through the county website. Property owners with a mortgage usually pay through escrow and their servicer handles the payments to the county.

Taxes that go unpaid become delinquent on January 1 after the due date. Interest at 9% to 10% per year is added to the outstanding balance. After three years without payment, the county begins tax forfeiture proceedings. Once the forfeiture is completed, the former owner loses all rights to the land. The county may then sell or manage the forfeited property. Property owners who are struggling to pay should reach out to the county as soon as possible.
