Marshall County Recorder

The Marshall County Recorder is the official custodian of all legal real estate records in the county. The office records deeds, mortgages, satisfactions, federal and state tax liens, easements, and other documents that affect ownership and use of land in Marshall County. All documents submitted for recording must meet Minnesota state standards. That includes a proper legal description, notary acknowledgment, original signatures, and the preparer's name on the first page.

Marshall County accepts e-recording, allowing professionals to submit documents electronically without mailing paper originals. For paper submissions, the office is located in Room 308 at 208 E Colvin Avenue in Warren. Documents must arrive by 4:15 PM each weekday to be processed that day, even though the office remains open until 4:30 PM. The office also accepts UCC filings, Torrens records, and certified copies can be ordered in person or by mail.

A well disclosure certificate submitted on its own costs $50. No separate fee is charged if the certificate is attached to the deed at the time of recording.

State transfer taxes apply to most real estate deals in Marshall County. The State Deed Tax under Minnesota Statutes Chapter 287 is 0.33% of the net consideration, with a minimum of $1.65. The Mortgage Registry Tax is 0.23% of the principal loan amount. Both taxes must be paid at the time the documents are submitted for recording and should be included with the check or electronic payment.

Property Tax in Marshall County

Property taxes in Marshall County are due in two installments each year under Minnesota Statutes Chapter 279. The first half is due May 15 and the second half is due October 15. Taxes not paid by May 15 become delinquent on January 1 of the next year and begin accruing interest at 9 to 10 percent per year.

Values are set as of January 2 each year following the rules under Chapter 273. The general framework for how taxes are levied and collected is governed by Chapter 272.
